Update for Week Ending 6/28/19

Week of 6/24 - 6/28

Water Tank Construction Continuing.


The drill crew is finishing up drilling on Spring St. @ Vine St. Drilling the last 400ft . So for the month the drill crew installed  537 ft of 10" HDPE Pipe
and 1437 ft. Of 8" HDPE Pipe.
The open cut crew was following behind connecting all the pipes,valves and fire hydrants at the intersections of Commercial St., Elm St., Bloom and Maple St..
We are planning to finally start on Marion St (Rt. 51) on Monday. 
We will be using traffic lights on Rt. 51 for traffic control. Please use caution around area of maple St., Cliff St. And Commercial St.. Thanks again for being patient with us during all this work.
We will not be working Thursday and Friday due to Holliday.

7. Gilbertsville, Otsego County

Faced with the threat of being permanently flooded due to dam construction, this village kept itself above water -- literally -- by earning a designation on the National Register of Historic Places. Situated in the town of Butternuts, the village of Gilbertsville maintains several striking architectural structures, including the Greek Revival-style Gilbertsville Academy, the Gothic-and-Tudor-style The Major’s Inn, and the Tudor-style Gilbert Block, which houses artist studios and a general store. The only hotel in the village is the Empire House, where locals converge for dinner and drinks on the outdoor patio. Gilbertsville Farm, a popular wedding venue just outside of the village offers glamping accommodations for weddings and retreats, as well as weekly goat yoga. Cooperstown is a mere 35-minute drive away, making Gilbertsville a doable day trip. It's the smallest village on this list (yes, villages and towns are different) with a population of less than 400.

NYCOM is New York State Conference of Mayor's: Update on State Legislative Session

State Legislative Session Ends – Yesterday the Senate and Assembly worked into the night and adjourned their legislative session early this morning. This update highlights the final status of a few key issues impacting local governments. A more comprehensive report will be issued next week. Thank you to all of our members who actively engaged in NYCOM’s successful advocacy efforts.

Transportation Funding:

·      Extreme Winter Recovery Program (i.e., pothole aid) – The entire $65 million in funding was restored and will be distributed to cities and villages as it has in recent years. Members of the Senate and Assembly heard our message loud and clear and fought to get this important aid restored. The base amount of CHIPS highway aid remains the same.

·     Arterial Maintenance Reimbursement – While the Legislature did not provide a long overdue increase in reimbursement funding for the 38 cities that maintain state arterial highways, we are pleased to report that both houses did pass our bill (A. 5990-A/S. 4048-A) to amend the statutory formula to reflect current (instead of 1987) road maintenance costs. NYCOM thanks Senator Tim Kennedy and Assemblywoman Nily Rozic for their stalwart efforts in achieving passage of this bill. We will now work with the sponsors and the Governor’s office to determine an acceptable means of implementing this legislation.

Zombie Properties The Legislature gave final passage to an important tool in the fight to remove zombie properties from your communities. NYCOM thanks the bill sponsors, Assemblyman Bill Magnarelli and Senator James Skoufis, for their leadership in securing approval of A. 1859-A/S. 5079-A, the Zombie Property Remediation Act of 2019. This bill, if approved by the Governor, would authorize municipalities to compel mortgagees to commence and complete a mortgage foreclosure proceeding or to issue a certificate of discharge of the mortgage for any property which has been certified abandoned.

E-Scooters and E-Bikes As NYCOM predicted last week, legislation
(A. 7431-B/S. 5294-A) has been passed by the Senate and Assembly to authorize electric bicycles and electric scooters under New York law. NYCOM worked closely with the bill sponsors, Assemblywoman Nily Rozic and Senator Jessica Ramos, as well as the chairs of the Assembly and Senate Transportation Committees (Assemblyman Bill Magnarelli and Senator Tim Kennedy, respectively), to include language that ensures municipal control of shared systems of e-scooters or e-bicycles in your city or village. Upon being signed into law by the Governor, the bill’s provisions would go into effect in 180 days.

Proposed Expansion of Prevailing Wage to Publicly Supported Private Projects – NYCOM, our municipal association partners, and a broad coalition of business groups were successful in beating back legislative attempts to expand New York’s expensive prevailing wage system to private construction projects that receive public funds.

Proposed Legalization of Adult-Use Recreational Cannabis While NYCOM did not take a position for or against legalization of cannabis, we did strongly insist on local control and local revenue if any such system was enacted. Ultimately, the Legislature did not pass legislation creating a state-regulated system for the cultivation and sale of recreational cannabis. Instead, the Senate and Assembly approved A. 8420-A (by Assemblymember Crystal Peoples-Stokes) and S. 6579-A (by Senator Jamaal Bailey), which decriminalizes possession of certain amounts of marijuana and expunges the records of certain prior convictions.

Proposed Interference with the Village Incorporation Process During the waning days of the legislative session, a number bills were introduced that would have halted the democratic process of village incorporation through various new provisions, including creating a temporary moratorium on such incorporations, broadening the acceptable reasons for a town supervisor to disapprove a petition for village incorporation, allowing for the residents of the entire town to vote on an incorporation, and increasing the minimum population of a new village from 500 to 1,000 residents. NYCOM is pleased to report that none of these proposals passed.

Dear Speaker Pelosi, Leader McConnell, Leader Schumer and Leader McCarthy,

On behalf of Mayors, Municipal and County Leaders from across the nation, we join together to urgently request that the September 11th Victim Compensation Fund (VCF) be fully funded and made permanent. This legislation is sponsored by a broad cross-section of Members of Congress from across the political spectrum and nation. As support continues to grow, we call on Congress to support the swift passage of the bipartisan H.R.1327/S.546 – Never Forget the Heroes: Permanent Authorization of the September 11th Victim Compensation Fund Act.

September 11, 2001 left an indelible mark on our nation. On that fateful morning, 2,977 lives were lost and thousands more were injured. Yet many more would develop illnesses from working on the scene. The heartbreaking reality is that more people may have died from 9/11-related injuries and diseases than were lost during the attacks themselves. The VCF provides compensation to individuals or surviving family members who were injured, sickened, or killed as a result of the 9/11 attacks, or the exposure to toxins as part of the recovery efforts at the Site of the World Trade Center, the Pentagon and the Shanksville crash site. On February 15, 2019, the VCF made the announcement that a funding shortfall would result in drastic cuts to all claims. This equates to reductions of 50 percent for all pending claims and a staggering 70 percent for future claims.

To be clear, this shortfall does not only affect individuals in New York, Washington D.C. and Pennsylvania where the attacks took place. First responders, law enforcement personnel and volunteers poured in from across the nation to render aid in the immediate aftermath of the most devastating attack on the U.S. mainland. To date, over 93,000 first responders from every state and from 434 out of 435 Congressional Districts are currently enrolled in the World Trade Center (WTC) Health Program. As local leaders, we understand how critically important the VCF is for our communities because we have witnessed our residents’ suffering firsthand.


In 2015, Congress authorized and fully funded the World Trade Center Health Program, providing medical monitoring and treatment for responders and survivors with 9/11-related injuries and illnesses. Congress also reauthorized the VCF, providing an additional $4.6 billion dollars in compensation for these victims and their families, many of whom are suffering or dying from respiratory diseases and cancer. Given the full scope of need and the record number of victims applying, the funding is quickly running out. Almost $5 billion has already been paid, while nearly 12,000 claims remain under review. Further, any responder or survivor who becomes ill after December 18, 2020 would be ineligible due to lack of funds.

As leaders, we are duty-bound to provide our heroes with the support they have rightfully earned, and to respect and cherish those who became ill after running into harm’s way to save lives on one of the darkest days of our nation’s history. The Never Forget the Heroes Act of 2019 affirms our responsibility as Americans to protect the victims of 9/11-related illnesses by reauthorizing the fund through 2090, and funding all current and future claims. We urge you to reauthorize the VCF by swiftly enacting H.R. 1327/S. 546. Those suffering from 9/11-related illnesses cannot wait, and we hope Congress does not wait to pass this important legislation.
